Data Protection & Confidentiality Agreement

1. Introduction

This Data Protection and Confidentiality Agreement ("Agreement") governs the protection, use, and confidentiality of information shared through the ConsultX platform. ConsultX is a technology platform that connects users with independent professionals including advocates, career counselors, mental health experts, dietitians, and other specialists.

By accessing or using the ConsultX platform, professionals and users acknowledge and agree to comply with the terms outlined in this Agreement.

2. Definition of Confidential Information

For the purpose of this Agreement, "Confidential Information" refers to any non-public information disclosed through the platform, including but not limited to:

• Personal identification information of users
• Consultation details and communication
• Documents uploaded or shared during consultations
• Professional advice or recommendations
• Technical or operational information related to the platform

Confidential Information may be shared in written, electronic, verbal, or digital form.

3. Obligation of Confidentiality

All parties accessing information through the ConsultX platform agree to:

• Maintain the confidentiality of all information obtained through the platform
• Use such information only for the purpose of providing or receiving consultation services
• Avoid unauthorized disclosure, distribution, or misuse of confidential information

Confidential information must not be shared with any third party without proper authorization or legal requirement.

4. Data Protection Measures

ConsultX implements reasonable technical and organizational measures to protect user data and confidential information, including:

• Secure server infrastructure
• Encrypted communication where applicable
• Restricted access to sensitive data
• Internal data protection protocols

However, users and professionals acknowledge that no digital system can guarantee absolute security.

5. Permitted Use of Information

Confidential information obtained through the platform may only be used for legitimate purposes related to providing consultations, receiving professional advice, improving platform services, or complying with legal or regulatory requirements. Any use of confidential information beyond these purposes is strictly prohibited.

6. Restrictions on Disclosure

Professionals and users must not:

• Disclose confidential information to unauthorized individuals
• Copy or distribute consultation content for commercial purposes
• Publish private consultation details without consent

Violation of these restrictions may result in account suspension, termination, or legal action.

7. Legal Disclosure

ConsultX may disclose certain information if required by law, regulation, or a lawful request from government or legal authorities. Such disclosure will be limited to the extent required by applicable law.

8. Data Retention

ConsultX may retain certain user information and consultation records for purposes including platform operations, dispute resolution, and compliance with applicable legal obligations. Data will be stored only for the duration necessary to fulfill these purposes.

9. Limitation of Liability

ConsultX takes reasonable steps to protect confidential information; however, the platform shall not be liable for damages resulting from unauthorized access caused by third-party actions, internet security vulnerabilities, or user negligence in protecting personal accounts.

10. Breach of Confidentiality

Any misuse, unauthorized disclosure, or breach of confidential information may result in immediate suspension or termination of platform access, investigation, and possible legal action.

11. Updates to Agreement

ConsultX reserves the right to modify or update this Agreement at any time. Continued use of the platform after updates constitutes acceptance of the revised terms.
