Governing the relationship between ConsultX and registered professionals
This Expert Service Agreement ("Agreement") governs the relationship between ConsultX ("Platform", "Company", "we", "our") and the professional registering on the platform ("Expert", "Professional", "you"). ConsultX operates as a technology platform that connects users with independent professionals for consultation services.
By registering as a professional and offering services through the ConsultX platform, you acknowledge that you have read, understood, and agreed to the terms of this Agreement.
The Expert acknowledges that they are acting as an independent contractor. Nothing in this Agreement shall be interpreted as creating:
Experts are solely responsible for the professional services they provide to users through the platform.
The Expert represents and warrants that:
ConsultX reserves the right to review or verify professional credentials and may suspend or terminate accounts where information is found to be inaccurate or misleading.
Experts may provide consultations to users through the platform using available communication methods, including video consultations, audio calls, and chat or messaging. Experts must ensure that services are provided only within their area of professional expertise and in accordance with applicable ethical and professional standards.
Experts agree to maintain the highest standards of professional conduct. Experts must not:
Violation of these standards may result in immediate suspension or termination of the Expert account.
Experts must maintain strict confidentiality regarding all user information obtained during consultations, including personal information, documents shared by users, and consultation discussions. Experts must not disclose or use such information for purposes unrelated to the consultation without the explicit consent of the user.
ConsultX provides the technological infrastructure that enables users and professionals to connect. ConsultX does not supervise consultations, does not control the advice provided by experts, and does not guarantee the outcome of professional services. Experts acknowledge that they remain solely responsible for the advice and services delivered to users.
Consultation fees may be set by the platform or agreed upon according to platform policies. ConsultX may charge a platform commission or service fee on consultations completed through the platform. Payments to Experts will be processed according to the platform's payout schedule after applicable deductions. ConsultX reserves the right to modify commission rates or payment policies with prior notice.
Experts agree not to solicit, encourage, or accept consultation requests from users outside the ConsultX platform if the user was originally introduced through ConsultX. Experts must not:
Violation of this clause may result in account termination and possible legal action.
ConsultX shall not be responsible for the professional advice provided by Experts, the outcomes of consultations, disputes between Experts and users, or any damages arising from services delivered by Experts. Experts acknowledge that they are solely responsible for the services they provide.
ConsultX reserves the right to suspend or terminate an Expert's account if:
Experts may not use the ConsultX name, logo, or branding for promotional purposes without prior written permission from the platform.
Experts must comply with all ConsultX platform policies, including Terms and Conditions, Privacy Policy, Teleconsultation Guidelines, and Cancellation and Refund Policies.
This Agreement shall be governed by and interpreted in accordance with the laws of India. Any disputes arising under this Agreement shall be resolved through arbitration or other dispute resolution mechanisms in accordance with applicable law.
